Another big sting out of Washington State captured another 21 men including TWO 19 year olds (Net Nanny 13). Really? It seems these sting operations are changing. They use to be a Mother offering up her kids. Now it seems like it is a teenage girl (~13) doing the bait and switch. Most of the people get charged with two crimes. Attempted Rape 2nd Degree and Communication with a Minor for Immoral Purposes. If one pleads guilty to both of these they would likely receive a 76.5 Month sentence. Indefinite SO registration and lifetime Parole (Community Custody). These are serious Class A felony offenses. Also the location of the arrests, Pierce County, pumps up the bail charges to often $250k or more! One thing to know about this county is they usually handle their cases quickly (everyone is in jail due to high bail). The county has had 2-3 sting operations and 26 cases and all have been resolved. I’m sorry to say it usually doesn’t end well: 1 suicide, 6 Guilty Trials and the remainder are pleas. Sometimes they will allow a plea out to a lesser charge (CM2 – Felony Class B) and may only get 2-3 years of prison (3 years Community Custody and 15 years of SO registration). Many of the other cases are averaging 7 years. I’m sorry to say, it is NOT a good situation. And roughly 90 of these now 205 Net Nanny cases have been completed. Trial conviction rate is > 90% with 1 acquittal and 1 dismissal that I’m aware of between 2015 and today (25 trials). I’ve seen some people with the BEST lawyers plea out on these cases. It is A DIFFICULT decision. It will likely be between 1-2 years before you stand at a trial. A plea can resolve the case within 6 months.  Many of those who have lost in a trial do appeal. The results of those appeals will be known in the coming months.

We continue our fight as we have chosen a Trial over a Plea (which adds to the costs). I feel for those caught in this last sting operation, especially the younger ones. Feel free to reach out and I’ll do my best to answer your questions.

    Hello i am sorry for hassling but my brother was fooled by what he believed was an adult woman in a recent sting in Sarasota, Florida. (Operation Intercept) He asking me to ask if you have any information regarding the ICAC Training Manual when It pertains to Florida? Or that operation in general. I will gladly provide more info with his permission regarding his situation if I can have you reply to me. Attorney Peter Allen have gave is tremendous insight but we cannot afford.him.

    Peter Aiken and his lawfirm (http://www.sexstinglawyer.com/) are out of Sarasota. You couldn’t ask for a better situation than you have–caught in Sarasota, FL where you have access to one of the best lawyers on these cases in the country. Find out the Plea deal on the table–there should be one by now (4 months after operation). I promise you there will be a PLEA deal on the table at this time unless it was very egregious texting. Peter and his firm will know the prosecutors and can work with them. The $10k (?) you pay is much better than a felony and SO registration. You need to think of opportunity cost here. If he his trying to charge $20k maybe that is something to think about and go elsewhere. Put up Bond, get out of Jail then begin fighting. Try to get job, even if minimal like Amazon warehouse/pizza delivery/etc. to help build up fund to pay this down. Any trial is likely 1-2 years away. The ICAC manual on this site IS the official one that is out there. I have confirmed this against released documents.

    Just a FYI: Most people in these cases get charged with the following below which looks like 21mo minimum sentence required. The one thing you have going for you is there is a lot of history in Florida on these cases. So, you’ll have a good understanding of your options. The PD should be aware of all options and prior histories assuming he has been working for past 2-3 years in current county.

    Use of Computer to Solicit a Child to Commit Sex Act
    – The crime of Soliciting a Child for Unlawful Sex is a Second Degree Felony in Florida and punishable by up to fifteen (15) years in prison, fifteen (15) years of probation, and a $10,000 fine. It appears this has minimum 21 month sentence.

    Traveling to Solicit a Child to Commit Sex Acts.
    – In Florida, the crime of Traveling to Meet a Minor for Unlawful Sex is a Second Degree Felony and punishable by up to fifteen (15) years in prison, fifteen (15) years of probation, and a $10,000 fine. It appears this has minimum 21 month sentence.
